Is Abortion Legal in North Carolina?

Effective July 1, 2023, most abortions are illegal in North Carolina after 12 weeks gestation. However, exceptions can be made through 20 weeks in cases of rape and incest and through 24 weeks for “life-limiting” fetal anomalies. Abortions are legal throughout the entirety of pregnancy for medical emergencies.[1] 

Ultrasounds are required prior to abortion in North Carolina. What is not required is the documentation of an intrauterine pregnancy (IUP). However, we strongly recommend an IUP be determined. Here’s why.

 

Why Do I Need an Ultrasound?

You may be wondering why you’d want an ultrasound if you’re considering abortion. The answer is that ultrasounds can help you make an informed and empowered decision for an unplanned pregnancy! They determine two key factors: viability, gestational age, and location of the pregnancy to rule out ectopic pregnancy.

 

What is Pregnancy Viability?

A viable pregnancy means that the pregnancy is progressing properly. For example, at about 6 ½ – 7 weeks gestation, the embryo should have a detectable heartbeat.[2] A goal of an ultrasound is to rule out a  a pregnancy in which the baby is not alive or is in the wrong location (ectopic pregnancy)—in either case, abortion isn’t indicated for treatment.

 

What is Gestational Age?

How far along am I? Your ultrasound can answer that question! It’s important to know how far along you are (also known as your gestational age), as North Carolina law prohibits most abortions beyond 12 weeks. 

If you intend to travel out of state for an abortion, be aware that the surrounding areas may prohibit abortion beyond a certain point in your pregnancy as well. Additionally, the abortion pill is only indicated until 10 week.[3]
